Montenegro's Court of Appeal overturned Do Kwon's extradition to the United States

The Court of Appeal of Montenegro overturned the decision on February 20 to extradite Do Kwon to the United States authorities, supporting the appeal of his lawyers.
The latest court ruling takes into account procedural flaws, especially the lack of clear justification and factual clarity in the High Court's extradition order requiring a retrial.
After the meeting of the council on March 5, 2024, the Court of Appeal of Montenegro issued a decision, which accepted the appeal of the defense of the defendant Kwon Do Hyun, annulled the decision of the Podgorica Supreme Court No. 146/24, the representative of the court said.
The court's review revealed inconsistencies and a lack of clear arguments in determining the priority of the US request over the request of South Korea. At the same time, the misinterpretation of legal protocols relating to electronic requests and requests for temporary detention is emphasized.
As a result, the case is redirected to the court of first instance for re-evaluation, which means another delay in an already protracted trial.
