DEBT Box asked the court to continue the proceedings with the SEC

The DEBT Box crypto company has asked the Utah District Court to reject the SEC's motion to terminate legal proceedings against it, calling the regulator's actions a "strategic maneuver."

The management of DEBT Box argues that the decision of the U.S. Securities and Exchange Commission (SEC) to dismiss the case is an attempt to achieve special treatment in federal courts for the organizations that it regulates. And most importantly, the SEC seeks to avoid possible sanctions due to its illegal actions, says DEBT Box. The company also fears that the agency may reconsider enforcement measures that could be applied to it in the future.

On January 30, the SEC filed a motion to dismiss the case against DEBT Box, explaining that the agency needed to evaluate the evidence in the case, conduct an internal audit and analyze the factors that could cause inaccuracies in the charges against the crypto company. In August, the regulator accused DEBT Box of fraud with cryptocurrencies worth $50 million. The company sold unregistered securities, so-called "software mining licenses," the SEC alleges.

However, the regulator was unable to provide sufficient evidence of its accusations. Therefore, Judge Robert Shelby instructed SEC lawyers to provide more precise arguments that the defendant was trying to sell crypto assets abroad in order to avoid regulation. DEBT Box also demanded that the hearings scheduled for March 7, 2024, be held without rescheduling, despite the SEC's motion to dismiss the lawsuit.

"The SEC wants to withdraw from this lawsuit on its own terms, while maintaining the ability to re-file a lawsuit against DEBT Box and other defendants at any time. Perhaps she will file a complaint with another court, as if nothing had happened. However, this particular case should not be allowed to take its course," the DEBT Box petition says.
